The New Hampshire state Senate recently killed a measure that would have made the still-controversial idea part of that state’s Doug Darrell countered that he grew the fifteen plants for his own personal religious and medicinal reasons. After six hours of deliberation, the jury nullified the law because, in its opinion, it was unjust to punish Mr. Darnell in these circumstances.

Jury Nullification in Illinois

Most jurors do not know that they have the right to find a defendant not guilty if such a finding would be unjust under the circumstances. Assuming that the judge informs the jury of this right, nullification could apply in several situations:

  • A borderline BAC (.08 or .09) DUI case, especially if the defendant has no criminal record and is otherwise sympathetic in some way,
  • Marijuana cultivation cases like the one described above, and
  • Women prosecuted under prostitution laws.
