For the purposes of 720 ILCS 5/25-1.9,”>concealing or masking the identity may consist of wearing a hood, mask, or otherwise deliberately concealing the face in such a manner as to make identification difficult or impossible. According to this criteria, it may be a matter of legal debate whether attempting to conceal one’s identity through the use of makeup or prosthetics would count as concealment under this law.
What Counts as Weapons?
For the purposes of this law, any “pistol, revolver, stun gun or taser or firearm or ballistic knife” would count as a weapon. This marks a broad definition of weaponry, though the above-stated instruments would have little use in most cases other than as weapons. Be careful, even if you legally can possess weaponry, if you are also going to be traveling hooded or with your identity otherwise concealed.
What are the Consequences of Possessing a Weapon While Masking Identity?
Persons found guilty of possessing a weapon while masking their identity are guilty of unlawful use of a weapon. Those found guilty of unlawful use of a weapon will be charged with a class 4 felony. There are a variety of conditions that intensify the consequences of a violation, and in this case, being found in violation while in the vicinity of the school upgrades the charges to a class 3 felony. Each weapon counts as a distinct violation, so be aware that possession of a knife and gun, for example, can be legally and criminally devastating.
