The Penalties Of A St. Patrick’s Day DUI

Just imagine this: you are driving in Schaumburg, and you’re almost home. 

Earlier that night, you were at a fun St. Patrick’s Day party. And, like anyone would, you had a couple of drinks.

You are just five minutes away from your home when, almost out of nowhere, a police car pulls up. The sound of the siren fills your vehicle, and you pull over.

The Penalties Of Your First DUI

The penalties of your first DUI can be, and often are, as follows:

  • A maximum of 364 days were spent in jail.

Regarding the latter, this is only applicable if your blood alcohol level is .16 or higher. And, if you were transporting a minor, you would need to complete 25 days of community service at a program that helps children.

A fine can also result from your first DUI:

  • A maximum fine of $2,500.
  • A minimum fine of $500 if your blood alcohol level was .16 or higher.
  • A minimum fine of $1000 if you were transporting a minor under the age of 16.

The Penalties Of Your Second DUI

A second DUI can, and often does, come with the following penalties:

  • A minimum of five days in jail or five days of community service.
  • A maximum of up to 364 days in jail.

You may also have to pay expensive fines if you receive a second DUI:

  • A maximum fine of $2,500 if the DUI is a class A misdemeanor.
  • A maximum fine of $25,000 if the DUI is a class 2 felony.
  • A minimum fine of $1,250 if your blood alcohol level was .16 or higher.
  • A minimum fine of $2,500 if you were transporting a minor under the age of 16.

Outside of the above, if you receive your second DUI less than twenty years after your first, your license will be revoked for five years.

The Penalties Of Your Third DUI

A third DUI is, generally speaking, a Class 2 felony. For this reason, the following penalties apply:

  • A minimum sentence of ten days in jail or, alternatively, community service.
  • A minimum sentence of ninety days in jail if your blood alcohol level was.16 or higher.
  • A maximum sentence of three to seven years in prison.
  • Being forced to complete 25 days of community service if you were transporting a passenger under 16.

Regarding the first penalty, you can be sentenced to community service if you are sentenced to a probation term.

Just as with your first and second DUIs, you can be fined any of the following:

  • A minimum fine of $2,500 if your blood alcohol level was .16 or higher.
  • A minimum fine of $25,000 if you were transporting a minor under the age of 16.
  • A maximum fine of $25,000.

If you receive your third DUI, your license will be revoked for a period of ten years.
