If Karina’s Bill Is Passed Into Law, What Will Happen To Your Firearms
posted on 5/5/24

Right now, as of April 23 of, 2024, Karina’s Bill is on the table. And, if Karina’s Bill passes, you, and your firearms, will be treated differently.

Educating yourself about the ways in which Karina’s Bill will affect your firearms and contacting a Schaumburg weapons charges defense attorney will allow you to protect your rights.

What Is Karina’s Bill?

If someone obtains an Order Of Protection, coupled with a firearm remedy, against a person who has allegedly harassed or abused them, then that individual’s firearms can be taken away for the duration of that Order.

Even though the above is true, this does not always happen; sometimes, the rules are never enforced, and a person who is not allowed to own firearms continues to hold onto the weapons that they own.

To protect victims of harassment and abuse from further violence, Karina’s Bill forces those who have an Order Of Protection against them, coupled with a firearm remedy, to surrender their firearms to law enforcement.

Unlike the current laws, Karina’s Bill requires a search warrant to be issued if there is probable cause regarding your ownership of firearms.

This search warrant must be executed within 96 hours of being issued. When it is executed, law enforcement will seize your firearms.

If an individual with an Order Of Protection against them wishes to transfer their firearms to a friend or family member – or anyone who isn’t law enforcement – they will find that, under Karina’s Law, they cannot legally do so.

What Happens To Your Firearms If Karina’s Bill Passes?

The answer to the question above is “Nothing.”

More specifically, the answer to that question is “Nothing,” as long as an Order Of Protection, coupled with a firearm remedy, is never filed against you.

If an Order Of Protection, with a firearm remedy, is filed against you, then law enforcement can, and will, seize the firearms that you legally own.

The above is true, even if an Emergency Order Of Protection is filed against you; if an Order, of this sort, is filed against you, you will rarely be given the ability to contest it or make any sort of case for yourself.

You may be able to reacquire your firearms, after that Emergency Order Of Protection expires. Or, alternatively, you may not, if that Order is expanded; this is a point of contention, for those opposed to Karina’s Bill.

Many people question the merit of Karina’s Bill, given the lack of due process regarding Emergency Orders Of Protection, coupled with the uncertainty regarding when and whether you will be able to regain your firearms.
