The Cost Of Reinstating A Revoked License
posted on 6/18/24

A revoked license is a huge inconvenience and can result in not only the inability to get around your area but also cost you money and job opportunities.  Hiring the right attorney to do the reinstatement can be the difference between driving again or missing job opportunities and the freedom and independence of being able to get around. Finding an attorney who is experienced in reinstating a revoked license and speaking with a Chicago driver’s license reinstatement attorney will allow you to regain your driving privileges.

At Glasgow & Olsson, we have over 25 years of experience with reinstatements before the time of the Illinois Secretary of State.

What Is A Revoked License?

It is important to understand that a license revocation lasts forever. The only way to get one’s license back is to take action to have it reinstated.

Just as an example, if someone is convicted of A DUI, then their license will be revoked indefinitely. After one year, and depending on the facts of their case, they have the privilege of asking the Secretary of State for a hearing to reinstate their license. However, a license reinstatement is not automatic or guaranteed.

On the day in which the license revocation period ends, the person whose license was revoked must petition the Illinois Secretary of State for a hearing with the Secretary of State administrative law judge.  That is after a new evaluation by a licensed Illinois Secretary of State provider, getting together the previous driving history, as well as all required documentation to prove that you are a safe and responsible driver in the state of Illinois.

If the hearing is successful, then they will start by getting a restricted driving permit, which will only allow them to drive approximately 60 hours per week within a finite area. Licenses can allow you to drive in unlimited status, but that is dependent upon your background and what you are suspended or revoked for. If the hearing is not successful because of inadequate documentation, bad testimony, or inadequate preparation for testimony, then your license will remain revoked.

Administrative Hearings Before the Illinois Secretary of State Can Be Complex

The rules covering the reinstatement of drivers licenses during the course of hearings before the Illinois Secretary of State are the administrative rules. They are quite different and have a different context and application than the rules of court.  Having an attorney who is knowledgeable in this area can mean the difference between you getting your license back or remaining in a revoked status.

Further, the documentary requirements of the hearings are quite complex, and failure to get things right can result in a denial that will cost you an additional four months of waiting before you can even apply for a new hearing.  Finally, the testimony that you give to the Illinois Secretary of State is of Paramount importance. If you get one question wrong, or one answer gives the wrong interpretation of what you were trying to say, it can lead to a declination of your hearing. Having an attorney who has the experience of 25 years of an administrative law hearing before the Illinois Secretary of State, can the difference between you driving or remaining revoked.

What Should You Do To Reinstate Your Revoked License?

The most important thing you should do to reinstate your revoked license is to work with an experienced attorney who can help you make a good case for yourself.

A good case for yourself, within the context of a license reinstatement hearing with the Secretary of State, is a case that addresses the reason why your license was revoked.

If you can address the reason why your license was revoked and do so in a manner that convinces the Secretary of State that you won’t commit the same offense again, then you MAY get your license reinstated.

On the other hand, though, if this does not occur, then you will not be able to get your license reinstated. And, if this occurs, then it can be very difficult to get it reinstated, even in the future.

The best way to bypass any issues is to work with an experienced attorney throughout the entire process. By doing so, you will have a much easier time regaining your driving privileges.
