What is an Order of Protection in Illinois?
posted on 11/5/24

An Order of Protection is a legal action that is issued by a court and signed off on by a judge when a victim of harassment or abuse is seeking relief from danger from another party.

If an Order of Protection was issued against you, you may not know your rights or what you can do to protect yourself and your good name. Or, you may be unsure about how it can affect your ability to interact with your loved ones. When an Order of Protection (OP) is issued against someone, it restricts their actions and interactions with the individuals who have the order successfully filed.

In Illinois, an Order of Protection that is violated may be charged as a Class A misdemeanor. Punishment can include as long as one year in jail and a fine of $2,500. The court may also determine that probation, counseling, and/or community service may apply.

To defend against an Order of Protection, having the assistance of an attorney can be critical. The Schaumburg Orders of Protection attorney at Glasgow & Olsson knows how to help you with a civil or criminal Order of Protection. Steps and actions can be taken early on to protect you and your family from the repercussions these charges can have.

How Long Does it Take To Get An Order of Protection in Illinois?

Let’s suppose another party decides to file an Order of Protection against you. Unless their case is considered an emergency, it will generally take 5 to 21 days. This is the amount of time for a respondent to be served with a Summons and the Petition for an Order of Protection.

However, should an Emergency Order of Protection be deemed necessary, it will be entered upon the conclusion of a hearing for an emergency order. The turnaround time to obtain an Emergency Order of Protection could be as little as 24 hours.

Someone who is experiencing potentially the most dangerous circumstances may be able to have their case heard and be given an Emergency Order of Protection. The problem is, if you are being accused of abuse by another party, and they obtain an Emergency Order of Protection against you, you may not even know this happened. This is a difficult situation to be in since defending against such accusations can be complicated, which is why having the assistance of an attorney can be beneficial to protect yourself and your rights.
