Why Voluntary Statements Are So Dangerous: How An Attorney Protects You From Unintentionally Supplying the State with Evidence

People frequently end up saying the officer didn’t read me my rights. Miranda rights only apply in situations where two elements exist:

  • You’re being questioned by a government actor and
  • You’re in custody

If one of these things does not exist, Miranda protections do not apply to the statements that you make, and the prosecution can use your statements against you.

When Miranda Does Not Apply

You Are Being Questioned by a Government actor, but not in Custody

If officers ask you questions but you are not in custody, then Miranda warnings are not required.

That means:

  • Your statements are considered voluntary
  • They are fully admissible in court

Even if you didn’t realize you could walk away or decline to answer, those statements can and will be used by prosecutors to build a case against you.  Government actors are police officers or anyone employed by the government.  Private security guards, loss protection agents, or random citizens are not government actors, and Miranda does not apply to them. 

You Are in Custody but Not Being Questioned

If you are in custody, but officers are not questioning you, Miranda does not apply because interrogation isn’t occurring.

  • The police do not need to read you your rights
  • Anything you volunteer can still be used against you

For example, if you are handcuffed in the back of a squad car and suddenly blurt out:

“I DID IT!”

There is no Miranda violation.

Why?

Because you were not being interrogated. You volunteered the statement. Voluntary statements are always admissible.

What Are “Voluntary” Statements?

“Voluntary” statements are any statements you provide without being compelled or subjected to custodial interrogation. Examples include:

  • Answering an officer’s questions when you’re not in custody
  • Offering information without being asked
  • Making spontaneous or impulsive remarks while in custody, but not under questioning

Voluntary statements are extremely dangerous because:

  • You typically didn’t need to say anything
  • Officers are free to use every word against you
  • Innocent comments can be twisted into damaging evidence

Even jokes or off‑the‑cuff remarks (“Yeah, that guy was a jerk!”) can be framed by prosecutors as motive, hostility, or consciousness of guilt.

  • Jurors place enormous weight on a defendant’s statements
  • Your words can be taken out of context
