It was reported that Sebrena Shabandir provided the recordings to journalist James O’Keefe and O’Keefe Media Group, which subsequently published them online. Following the publication of the recordings, State Farm terminated Kirkpatrick’s employment in March 2025.

Kirkpatrick responded by suing Shabandir, O’Keefe, and O’Keefe Media in an Illinois state court. Kirkpatrick alleged that these actions were an invasion of his privacy and in violation of the Illinois Eavesdropping  Act.

The Illinois Eavesdropping Act is a state law that regulates when people can legally record or listen to private conversations.
