Every order of protection says something similar: you cannot engage in specific types of conduct, and, in nearly every case, this conduct involves you being around/contacting a particular individual.

For example, if an ex-girlfriend files an order of protection against you, you can no longer contact them. Or, for that matter, be around them in nearly any capacity.

If you currently live with this person, share custody of a child with them, or even work with them in some capacity, then an order of protection can jeopardize all of that.

You may be forced to move out, lose custody of your child, or even be forced to resign from your job. And these are just some of the things that can occur if an order of protection is filed against you.

How Can You Fight An Order Of Protection?

The best way to fight an order of protection is to work with an attorney who knows how to do so.

You must go over the facts of your case with the attorney you have hired. By doing so, your attorney will help you figure out what evidence to present and, in turn, how to present this evidence.

Just as an example, if the person who filed the order against you made a claim that can be disproven, then you can present that evidence to refute their claims.

Outside of working with the evidence you have already, your attorney can help you gather evidence that supports your claims. This, too, must be presented.

The process of fighting an order of protection can take some time. If you do what your attorney says, go to every court date, and, most importantly, comply with the order, you can get it removed.

On the other hand, if you break the terms of the order of protection that was filed against you, you could face criminal charges. These will make it more difficult for you to get the order removed.

What Happens If You Don’t Fight An Order Of Protection?

The exact outcome is dependent on the order of protection against you.

Even so, though, the outcome will usually be quite similar: the order of protection will be entered, and, as such, you can be ordered not to be around or contact the person who filed the order against you.

If you do come in contact with them – or are put in a situation where you are forced to; this person shows up at the restaurant where you are eating dinner, the grocery store, or the movie theater you are at, for example – anything that violates the order, you could face criminal charges.  Once the order is in place, the police and the Courts don’t care about why the order was entered. They don’t want to hear that story. They only care about one thing. Was the order entered, and did you violate the terms of the order?
