You could be forced to leave your home in three main ways in a divorce. Although these are the most common, they are not the only reasons you may have to leave your home if you are going through a divorce.

01: Agreeing To Leave

On the surface, this may sound off: after all, if you agree to leave, then you weren’t really forced out, right?

02: Your Spouse Files A Restraining Order Against You

Your spouse could file a restraining order against you. And, if they do so, you will be forced to leave your home.

Outside of this possibility, your spouse could also file an emergency order of protection, among other orders of protection. This order of protection – among others – will also force you to leave your home.

If you have not dealt with the order of protection prior to your divorce, then this could affect the outcome of that divorce. You might have a harder time getting your fair share, among other possibilities.

03: You Could Be Evicted

You could be evicted from your home if your name is not on the title. This is a legal measure, and as such, it is not something your spouse can do without going through the legal system.

Just as an example, if your spouse does not go through the eviction process – or file a motion for exclusive ownership – then they cannot, legally, kick you out.

Even so, if their name is solely on the title, then you still may be forced to leave your home. It just may take a little while for that to happen.
