3 Major Problems A Domestic Battery Conviction Will Lead To
posted on 10/6/24

Domestic battery is when someone causes physical harm to a family member or household member. Or alternatively, make physical contact with a family member or household member that is insulting/provoking.

Both of the actions that comprise domestic battery can lead to serious criminal consequences. That is not all they can lead to, though: domestic battery can lead to other, very serious problems that prevent you from living your life.

Going over the three major problems that a domestic battery conviction will lead to, and speaking with a Schaumburg civil orders of protection attorney will make it easier for you to protect your rights.

Watch Attorney Thomas T. Glasgow discuss why obtaining a lawyer with experience when facing a domestic battery conviction is always the right choice on YouTube and TikTok.

Problem 1: You May Lose Custody Of Your Children

Child custody in Illinois is determined by what is in your child’s best interests. And, if you have been convicted of domestic battery, then the court may feel that your presence is not in the best interests of your child.

The above can significantly reduce your current child custody arrangement. Or alternatively, it could lead to you needing to visit your child while supervised, making it harder for you to spend time with them.

Out of all the child custody outcomes, a domestic battery conviction can lead to, the worst is as follows: you no longer have access to your child at all due to your conviction.

Problem 2: You Will Lose Access To Your Firearms

A domestic battery conviction will lead to the loss of your firearm ownership rights.

Just as an example, if you own several weapons, then a domestic battery conviction will force you to give up these weapons. And on top of this, you will be unable to purchase any weapons due to your conviction.

The above is true at the Federal level. Even if your conviction was in another state, you will lose your right to purchase/own firearms of any sort.

If you work with firearms as part of your job, you may lose this job due to your conviction.

Problem 03: You May Have A Hard Time Finding Housing

Many landlords and property managers conduct thorough background checks on their tenants. If your name pops up on a background check and you have a domestic battery conviction, they may be reluctant to let you rent.

The same is true for public housing. Someone who relies on public housing may be unable to make use of the services due to their domestic battery conviction.

Outside of the above, if you already own a home, then this problem is of little consequence. The two other issues may very well affect you, though, which is something to remember.
